Official Rules – AGC Edge Sweepstakes
These are the Official Rules for the AGC Edge Sweepstakes (“Sweepstakes” or “Promotion”). The Sweepstakes is sponsored by Associated General Contractors of America, Inc., 2300 Wilson Blvd., Suite 300, Arlington, VA 22201 (also referred to as “AGC”).
NO PURCHASE IS NECESSARY TO ENTER OR WIN. MAKING A PURCHASE WILL NOT INCREASE THE ODDS OF WINNING.
1. Eligibility.
1.1. Open to Legal Residents.
o The Promotion is open to legal residents of the 50 United States, the District of Columbia and the Commonwealth of Puerto Rico, except where prohibited by law, who are 18 years of age or have reached the age of majority in their jurisdiction of residence at the time of entry, whichever is greater. No purchase is necessary.
1.2. Exclusions.
o Employees and stakeholders of Associated General Contractors of America, Inc., its affiliates, advertising and promotion agencies, and any entity involved in the development, production, implementation, administration, or fulfillment of the Promotion (collectively referred to as “Promotion Entities”) and their immediate family members and/or those living in the same household of such persons, whether related or not, are not eligible to enter the Promotion. The Sweepstakes is subject to all applicable federal, state, and local laws and regulations and is void where prohibited.
2. Entry.
2.1. Promotion Period.
o The Sweepstakes will run from March 20, 2024, to March 22, 2024. (“Promotion Period”).
2.2. How to Enter.
o To enter, individuals must submit their contact information and other requested information through an online entry form.
o Convention Entry: Attendees of AGC’s 2024 Annual Convention in San Diego, CA, can enter the Sweepstakes during the Promotion Period by visiting the AGC Edge booth/table and following the instructions for submitting an online entry on site.
o Alternative Method of Entry: Any eligible individual, whether attending AGC’s 2024 Annual Convention or not, can enter the Sweepstakes by accessing and completing the online form at https://edge.agc.org/convention24/ during the Promotion Period.
2.3. Restrictions.
o Limit one (1) entry per person. Associated General Contractors of America, Inc. will disqualify anyone found to have submitted multiple entries.
2.4. Conditions.
o Entrants agree to be bound by these Official Rules and the decisions of Associated General Contractors of America, Inc., which are final and binding on all matters relating to the Sweepstakes. Associated General Contractors of America, Inc. is not responsible for any typographical or other errors in printing the offer, administration of the Sweepstakes, or the announcement of the prizes or for lost, late, misdirected, damaged, incomplete, or illegal entries.
2.5. Participant’s Consent.
o Entry constitutes the entrant’s consent to participate in Promotion and conveys to the Associated General Contractors of America, Inc. the right to contact the entrant in the future. See the Privacy section below for more information.
3. Drawing.
• Associated General Contractors of America, Inc. will choose the winners from all eligible entrants through random drawings. Drawing will take place on March 25, 2024. Winners will be sent a private email from the Associated General Contractors of America, Inc. and receive further instructions on how to claim their prize. If a winner is not eligible or if Associated General Contractors of America, Inc. cannot contact the winner, or if the winner fails to respond to contact from Associated General Contractors of America, Inc. within 15 days, the winner’s prize will be forfeited, and an alternate winner may be selected at AGC’s sole discretion. The odds of winning depend on the number of entries received.
4. Prizes.
4.1. Award. Three (3) winners will be chosen. Each winner will receive a YETI Hopper Flip 8 Portable Soft Cooler. Prize details not set forth herein are the sole discretion of Associated General Contractors of America, Inc., to the extent allowed by law. Associated General Contractors of America, Inc. reserves the right to substitute a prize of equal or greater approximate retail value if an offered prize is unavailable. No substitution or transfer of prizes is permitted by winners. Winners will be sent a private email with instructions for providing an address for the shipment of their prize, such shipment cost to be borne by Associated General Contractors of America, Inc.
4.2 Prize Value
o Approximate retail value of each YETI Hopper Flip 8 Portable Soft Cooler: $200,
o Total approximate retail value of prizes: $600
4.3. Expenses and Taxes. Prize winners are solely responsible for any expenses incurred in connection with the prizes and for all applicable income taxes that may be affiliated with prize acceptance.
5. Winners List.
• For an Official Prize Winners List (available 30 days after Promotion Period end date) or a copy of these Official Rules, send a self-addressed, stamped envelope to Associated General Contractors of America, Inc. Attn: AGC Edge Sweepstakes, 2300 Wilson Blvd, Suite 300, Arlington, VA 22203.
6. Privacy.
• By entering into this Promotion, you also agree to Associated General Contractors of America, Inc.’s use of your personal information as described in the Associated General Contractors of America, Inc. Privacy Policy at www.agc.org/privacy-policy. Personal information collected by entrants may be incorporated into AGC’s general database of members and other contacts. AGC’s primary objective in collecting such information is to promote or provide services and benefits to members and customers. AGC does not sell personally identifiable data to third parties solely for AGC’s commercial gain, but AGC does share such information in its database with third parties from time to time, such as in furtherance of business relationships (e.g., with sponsors and affinity partners) that we believe are in members’ interests. 7. Disputes; Miscellaneous.
7.1. Governance. The Promotion is subject to federal, state, and local laws, and is void where prohibited by law. Entrants agree to be bound by these Official Rules, which are final and binding on all matters relating to the Promotion.
7.2. Associated General Contractors of America, Inc.’s Rights. Associated General Contractors of America, Inc. can void any entrant’s entry who it believes has attempted to tamper with or impair Promotion administration, security, fairness, or proper play. Associated General Contractors of America, Inc. reserves the right to modify, suspend, or terminate the Promotion if necessary due to circumstances beyond Associated General Contractors of America, Inc.’s reasonable control.
7.3. Limitation of Liability. To the extent allowed by law, all entrants agree to release and hold harmless Associated General Contractors of America, Inc. and its affiliates, and officers, directors, shareholders, and employees from and against any claim or cause of action arising out of or related to the Promotion, administration of the Promotion, or any Promotion prize, including but not limited to: (a) any technical errors associated with the Sweepstakes, including lost, interrupted or unavailable Internet Service Provider (ISP), network, server, wireless service provider, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone, cellular tower or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties; (b) unauthorized human intervention in the Sweepstakes; (c) mechanical, network, electronic, computer, human, printing or typographical errors; (d) any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Sweepstakes, (e) any other errors or problems in connection with the Sweepstakes; or (f) injury, death, losses or damages of any kind, to persons or property which may be caused, directly or indirectly, in whole or in part, from entrants participation in the Sweepstakes or acceptance, receipt or misuse of a prize. Entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.
7.4. Choice of Law and Venue. All matters arising out of or relating to the Promotion, including these Official Rules, are governed by and shall be construed in accordance with the laws of the state of California without giving effect to the conflict of laws rules thereof. All disputes arising out of or relating to the Promotion shall be resolved exclusively in the federal or local courts located in the District of Columbia. By participating in the Promotion, each entrant hereby consents to the jurisdiction and venue of such courts and waives and objects to same.
7.5 Disputes. Except where prohibited, the entrant agrees that any and all disputes that cannot be resolved between the parties, and all claims and causes of action arising out of or relating to the Promotion or any prize awarded, or the determination of winner shall be resolved individually, without resort to any form of class action. Further, in any such dispute, under no circumstances will entrant be permitted to obtain awards for and hereby waives all rights to claim punitive, incidental, or consequential damages or any other damages, including attorneys’ fees. Entrant further waives all rights to have damages multiplied or increased.
7.6 Severability. If any provision of these Official Rules is determined to be invalid or unenforceable, such provision shall be deemed severed from these Official Rules and the remaining provisions shall continue to be valid and enforceable to the fullest extent permitted by law. In the event of such a determination, Associated General Contractors of America, Inc. reserves the right to modify the Official Rules to the extent necessary to make them enforceable while maintaining their intent.
